Please read these Terms of Service ("Terms") carefully before using the DunDunDun mobile application ("App") operated by DunDunDun ("we", "our", or "us").
Acceptance of terms
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
Age requirement
You must be at least 21 years of age to use this App. By using the App, you represent and warrant that you are at least 21 years old. The App is designed to help users discover cocktails and bars, and is intended exclusively for users of legal drinking age in the United States.
We reserve the right to terminate your access to the App if we have reason to believe you do not meet this age requirement.
Account and user conduct
When using the App, you agree to:
- Provide accurate information when creating your taste profile.
- Use the App only for its intended purpose of cocktail and bar discovery.
- Not use the App to promote excessive or irresponsible alcohol consumption.
- Not attempt to reverse engineer, decompile, or disassemble the App.
- Not use the App in any way that violates applicable laws or regulations.
- Not interfere with or disrupt the App's functionality or servers.
- Comply with our Community Guidelines whenever you post photos, reviews, or other user-generated content.
Responsible drinking
DunDunDun promotes responsible drinking. We encourage all users to:
- Drink responsibly and in moderation.
- Never drink and drive.
- Be aware of your limits and local laws regarding alcohol consumption.
- Seek help if you or someone you know has a drinking problem.
Content and recommendations
Taste profiles and recommendations
The App provides drink recommendations based on your taste profile preferences. These recommendations are algorithmic suggestions and do not constitute professional advice. Drink availability, pricing, and quality may vary by venue.
Bar and venue information
Information about bars and venues displayed in the App is provided for informational purposes only. We make reasonable efforts to keep this information accurate, but we do not guarantee the accuracy, completeness, or timeliness of venue information including hours, menus, pricing, or availability.
User-generated content
When you submit reviews, ratings, photos, or other content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content within the App. You are solely responsible for the content you submit, and agree to our Community Guidelines.
Intellectual property
The App, including its design, features, content, and underlying technology, is owned by DunDunDun and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our express written permission.
Disclaimers
The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to:
- Merchantability and fitness for a particular purpose.
- Accuracy or reliability of drink recommendations.
- Uninterrupted or error-free operation of the App.
- The quality, safety, or legality of any bar or venue listed.
Limitation of liability
To the maximum extent permitted by law, DunDunDun shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to:
- Any decisions made based on drink recommendations.
- Experiences at bars or venues discovered through the App.
- Loss of data or taste profile information.
- Any health-related issues arising from alcohol consumption.
Indemnification
You agree to indemnify and hold harmless DunDunDun, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the App or violation of these Terms.
Privacy
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
Modifications to the App and Terms
We reserve the right to modify, suspend, or discontinue the App at any time without notice. We may also update these Terms from time to time. Continued use of the App after changes to the Terms constitutes acceptance of the revised Terms.
Governing law
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.
Termination
We reserve the right to terminate or suspend your access to the App at any time, without notice, for any reason, including violation of these Terms.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
